Judge’s lenient judgement after consideration

Hsinchu engineer sentenced to 20 days in detention with a 2-year probation for playing Polymarket

According to the Hsinchu District Court’s criminal summary judgement, an engineer surnamed Liu from Hsinchu, had placed bets on the prediction platform “Polymarket” regarding the Taiwan Presidential Election event last year.

On December 11th of last year, Liu bet on Ko Wen-je winning, placing a bet of 49.99 USDC with odds of 1:5.2631.

If Ko Wen-je had won, he would have won 263.1 USDC. In the end, he lost about NT$1,600 and was discovered by the police due to the impact on the fairness of the election results.

Hsinchu District Court sentenced Liu to 20 days in detention with a 2-year probation for the crime of gambling with election results as the target on the internet.

Lenient judgement by the judge

Hsinchu District Court considered that Liu had admitted his offense and had an acceptable attitude, and the period of illegal gambling was not long. Therefore, he was sentenced to 20 days in detention, with a fine of NT$1,000 per day if converted.

In addition, the judge considered that Liu had no prior convictions and had confessed to his offense after the investigation and trial. It is believed that Liu will not reoffend, so he was granted a 2-year probation as a fresh start.

In a previous report, according to Article 88-1 of the President and Vice President Election and Recall Act, any gambling conducted in public places or places accessible to the public with election results as the target may face imprisonment for up to six months or a fine.

This also applies to gambling conducted through telecommunication devices, the internet, and other means. Additionally, providing a venue for gambling or engaging in group gambling may face imprisonment for up to five years and a fine.
